International arbitration has always been an effective dispute resolution mechanism, particularly for transnational commercial disputes. In recent times, it has seen a massive surge in popularity, making it the default mode of dispute resolution for complex international commercial disputes. The increasing use of international arbitration has also led to its increasing judicialization and a homogenization and codification of its principal rules.
This Webinar will focus on growth of arbitration and track the development of its key concepts and tools with specific reference to India. We will inter alia cover introduction to Indian Arbitration Act, why arbitration is preferred over the orthodox dispute resolution- litigation, difference between seat and venue, how to draft an arbitration clause to avoid multiplicity of legal proceedings, foreign seated institutional arbitration, the preferred way, enforcement of foreign awards and domestic awards, recent pro arbitration developments in India.
